As of August 16, 2025, there are two primary ways individuals and businesses may receive a "tariff refund check" or rebate:
1. Duty Drawback and Tariff Refunds for Businesses
Duty Drawback: This is a refund of import duties paid on goods that are subsequently exported or destroyed under U.S. Customs and Border Protection (CBP) supervision.
Tariff Refunds: Businesses may be eligible for refunds on Section 301 tariffs (primarily those on imports from China) if their products were subject to tariffs that are later found to be unlawful or are granted exclusions from those tariffs.
How businesses can obtain these refunds:
Confirm your products' eligibility for a tariff exclusion, particularly for Section 301 tariffs.
Work with a Customs Broker or specialist firm (like USA Customs Clearance or Sandler, Travis & Rosenberg, P.A.) to navigate the complex process.
Submit a Post Summary Correction (PSC) to CBP with supporting documentation for Section 301 refunds.
File claims electronically through the Automated Commercial Environment (ACE) for duty drawbacks, using forms like CBP Form 7551 and 7553.
If an entry has been liquidated, businesses can still file a protest within 180 days to claim a Section 301 tariff refund, according to Great Lakes Customs Law.
2. Potential Tariff Rebate Checks for Individuals
Political Discussion and Proposed Legislation:There's been recent discussion, including from President Trump and Senator Josh Hawley, about potentially issuing tariff rebate checks to Americans, similar to past stimulus checks.
"American Worker Rebate Act": Senator Hawley has introduced a bill that would provide rebates of at least $600 per adult and dependent child, which would phase out at higher income levels, according to NBC News.
Uncertainty: While this proposal has been floated, there's no guarantee that such checks will become a reality, as the legislation faces political hurdles and economists have voiced concerns about its potential impact, notes CNBC and CNN.
To check the status of a potential tariff rebate or other government refund:
IRS Where's My Refund Tool: For tax refunds, including potential tariff rebates that might be issued through the tax code, you can use the IRS's "Where's My Refund" tool online or via the IRS2Go mobile app.
CBP Automated Clearinghouse (ACH) Refund Process: If you're a business enrolled in the ACH Refund process, refunds are electronically generated to your bank account, and you can contact the ACH Refund Help Desk for inquiries.
Important notes:
It's crucial to distinguish between tariff refunds for businesses, which are based on specific import/export activities or tariff exclusions, and the proposed tariff rebate checks for individuals, which are a matter of ongoing political discussion.
The duty drawback program has been modernized to simplify recordkeeping and extend the claim period to five years, according to Aprio.
Businesses seeking duty drawback or tariff refunds should carefully consider the documentation requirements and deadlines involved or seek assistance from customs specialists.
The IRS typically updates its refund information once every 24 hours, and while you can call them, wait times can be long, according to USA.gov.
